1. Acceptance of Terms

By accessing or using the Safe Nomads website and services (“Platform”), you agree to be bound by these Terms & Conditions (“Terms”).

If you do not agree, you must not use our Platform.

2. Description of Services

Safe Nomads provides:

  • A marketplace for nomad-ready accommodations
  • Workspace equipment rentals (monitors, chairs, etc.)
  • Mobility rentals (including electric scooters and bicycles)
  • A certification program for properties

We act primarily as an intermediary platform, not the direct provider of accommodations.

3. Eligibility

You must:

  • Be at least 18 years old
  • Have the legal capacity to enter into contracts
  • Provide accurate and complete information

We reserve the right to suspend or terminate accounts at our discretion.

4. Marketplace Role & Third-Party Services

Platform Disclaimer

  • Safe Nomads does not own, control, or manage listed properties
  • Hosts and service providers are independent third parties

No Guarantees

We do not guarantee:

  • Accuracy of listings
  • Quality, safety, or legality of accommodations
  • Availability or condition of properties or services

User Responsibility

You agree that:

  • Any booking or agreement is directly between you and the host/provider
  • You are responsible for reviewing listings and terms before booking

5. Bookings & Payments

  • Payments may be processed through third-party providers
  • Prices, fees, and taxes may vary
  • All bookings are subject to availability

Cancellations & Refunds

  • Governed by the host/provider’s policies unless otherwise stated
  • Safe Nomads is not responsible for issuing refunds unless required by law

6. Workspace & Equipment Rentals

By renting equipment (monitors, chairs, accessories):

You agree to:

  • Use equipment responsibly and as intended
  • Return items in the same condition (reasonable wear accepted)

You are responsible for:

  • Damage, loss, or theft
  • Costs of repair or replacement

We reserve the right to charge deposits or fees.

7. Mobility Rentals (Scooters & Bicycles)

Assumption of Risk

You acknowledge that using scooters or bicycles involves inherent risks, including:

  • Injury or death
  • Property damage
  • Accidents due to road conditions or third parties

You voluntarily assume all risks.

User Responsibilities

You agree to:

  • Comply with all local laws and traffic regulations
  • Use protective gear where required or recommended
  • Not operate under the influence of alcohol or drugs
  • Ensure safe operation at all times

Liability Waiver

To the maximum extent permitted by law:

  • Safe Nomads is not liable for any injury, damage, or loss arising from use of rented mobility equipment
  • You waive any claims against Safe Nomads related to such use

Indemnification

You agree to indemnify and hold Safe Nomads harmless from any claims, damages, or legal actions arising from your use of mobility equipment.

8. Certification Program

Nature of Certification

  • Certification indicates that a property meets certain nomad-ready criteria at the time of evaluation
  • It is not a guarantee of ongoing quality, safety, or compliance

No Liability

Safe Nomads is not responsible for:

  • Changes in property conditions after certification
  • Errors or omissions in certification assessments

Right to Revoke

We may revoke certification at any time without liability.

9. User Conduct

You agree not to:

  • Violate any laws or regulations
  • Provide false or misleading information
  • Damage property or equipment
  • Interfere with the platform’s operation
  • Harm other users or third parties

We may suspend or terminate accounts for violations.

10. Intellectual Property

All platform content (branding, text, design, software) is owned by Safe Nomads or its licensors.

You may not:

  • Copy, distribute, or exploit content without permission

11. Limitation of Liability

To the fullest extent permitted by law:

Safe Nomads shall not be liable for:

  • Indirect, incidental, or consequential damages
  • Loss of income, profits, or data
  • Injuries, damages, or losses related to:
    • Accommodations
    • Rentals (equipment or mobility)
    • Third-party services

Our total liability shall not exceed the amount paid (if any) for the service in question.

12. Indemnification

You agree to defend, indemnify, and hold harmless Safe Nomads from any claims, damages, liabilities, and expenses arising from:

  • Your use of the Platform
  • Your violation of these Terms
  • Your interactions with hosts or third parties

13. International Use

Safe Nomads operates globally.

By using the Platform:

  • You agree to comply with local laws where you use services
  • You acknowledge that legal protections may vary by country

You agree that:

  • Any disputes will be handled under the governing law defined below

14. Governing Law & Dispute Resolution

These Terms shall be governed by the laws of:

Colombia

Dispute Resolution

  • Disputes shall first be attempted to be resolved informally
  • If unresolved, they may be subject to binding arbitration or courts in the chosen jurisdiction

15. Force Majeure

We are not liable for failure or delay due to events beyond our control, including:

  • Natural disasters
  • Government actions
  • Internet or infrastructure failures

16. Modifications

We may update these Terms at any time.

Continued use of the Platform constitutes acceptance of the updated Terms.

17. Termination

We may suspend or terminate your access at any time without notice if you violate these Terms.
